1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of ubuntumoves.com (the "Site") and any purchase you make from Ubuntu Moves LTD ("Ubuntu Moves," "we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please don't use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you confirm you meet this requirement.

3. About Ubuntu Moves

Ubuntu Moves makes sustainable yoga mats grounded in the African philosophy of Ubuntu, "I am because we are." A portion of every mat sold, currently 7.5%, supports programs for children with Down syndrome in South Africa and Zimbabwe.

Ubuntu Moves LTD is the for-profit Colorado company that sells products on this Site. Ubuntu Moves Global is a separate, related nonprofit organization currently in the process of obtaining 501(c)(3) tax-exempt status, through which our impact programs are intended to operate. Purchases made on this Site are purchases of goods, not charitable donations, and are not tax-deductible.

4. Products, Pricing & Availability

We strive to display accurate product descriptions, images, and pricing, but we don't warrant that any of this content is error-free. We reserve the right to correct errors, change or update pricing, and modify or discontinue products at any time without notice. All prices are listed in U.S. dollars unless stated otherwise.

From time to time, we may sell limited, numbered editions of our products. Numbering, signatures, or other details of a limited edition are as described on the Site at the time of your order and may vary between releases.

5. Orders & Payment

When you place an order, you're making an offer to buy the product(s) in your cart. We reserve the right to accept or decline any order, including for reasons such as suspected fraud, pricing or listing errors, or inventory issues. Your order is not accepted until we send you an order confirmation.

Payments are processed securely through our third-party payment processor. By providing payment information, you represent that you're authorized to use that payment method.

6. Shipping & Delivery

Shipping costs and estimated delivery times are calculated and displayed at checkout. We currently ship within the United States; local pickup may be available for select releases. Title and risk of loss for products pass to you upon delivery to the shipping carrier. Delivery estimates are not guarantees, and Ubuntu Moves is not responsible for carrier delays outside our control.

7. Returns, Exchanges & Refunds

We want you to love your mat. If you're not satisfied, you may return an unused product in its original condition within 30 days of delivery for a refund or exchange. To start a return, contact us at hello@ubuntumoves.com with your order number. Shipping costs for returns may be the customer's responsibility unless the return is due to our error (e.g., a defective or incorrect item).

Refunds are issued to the original payment method once we've received and inspected the returned item.

8. Product Use, Care & Health Disclaimer

Our mats are made from natural materials, including FSC-certified cork and natural rubber, and are designed for general yoga and movement practice. As with any physical activity, consult a physician before beginning a new exercise practice, particularly if you have a pre-existing health condition. Use your mat on a flat, stable surface and follow any included care instructions to preserve its natural materials.

Ubuntu Moves is not liable for injuries arising from use or misuse of our products, to the fullest extent permitted by law.

9. Text Message (SMS) Terms

By opting in to text messages from Ubuntu Moves (for example, by entering your phone number at checkout, on the Site, or in a signup form, and agreeing to receive texts), you agree to the following:

• You consent to receive recurring marketing and transactional text messages from Ubuntu Moves, sent using automated technology, including order and shipping updates, cart reminders, product launches, and promotions.

• Consent to receive marketing texts is not a condition of any purchase.

• Message frequency varies. Message and data rates may apply.

• Reply STOP at any time to cancel; you'll receive a one-time confirmation that you've been unsubscribed. Reply HELP for assistance, or email hello@ubuntumoves.com.

• We and our messaging partners are not liable for delayed or undelivered messages, and not all carriers are supported.

• You represent that you are the account holder for the mobile number provided, or have the account holder's permission to opt in.

These SMS terms are part of, and incorporated into, these Terms & Conditions.

10. Intellectual Property

All content on the Site, including the Ubuntu Moves name, logo, graphics, photography, copy, and design, is owned by Ubuntu Moves LTD or its licensors and is protected by trademark, copyright, and other intellectual property laws. You may not use, reproduce, or distribute any of this content without our prior written permission.

11. User-Generated Content

If you submit reviews, photos, testimonials, or other content to us (including by tagging us on social media), you grant Ubuntu Moves a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, display, and distribute that content in connection with marketing and promoting Ubuntu Moves, across any media. You confirm you have the right to grant this license and that your content doesn't violate any law or third-party right.

12. Prohibited Uses

You agree not to use the Site to: violate any law; infringe our or any third party's intellectual property or other rights; transmit malware or engage in unauthorized access; scrape or harvest data without permission; or interfere with the Site's normal operation.

13. Third-Party Links & Services

The Site may contain links to third-party websites, including our impact partner organizations, that we don't control and aren't responsible for. Your use of those sites is governed by their own terms and policies.

14. Disclaimers

The Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, except as required by law. We don't warrant that the Site will be uninterrupted, secure, or error-free.

15. Limitation of Liability

To the fullest extent permitted by law, Ubuntu Moves and its founders, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, even if we've been advised of the possibility of such damages. Our total liability for any claim relating to your order will not exceed the amount you paid for the product giving rise to the claim.

16. Indemnification

You agree to indemnify and hold Ubuntu Moves harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state or federal courts located in [Denver County], Colorado, and you consent to that jurisdiction and venue.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19. Changes to These Terms

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced here, make up the entire agreement between you and Ubuntu Moves regarding the Site and your purchases.
